Bankruptcy Basics
Endgarnishment
Considering Bankruptcy can keep you up nights worrying! Perhaps that is as it should be.

Bankruptcy is a proceeding under the authority of the U.S. government. Federal proceedings are complicated and must be taken seriously. Filing Bankruptcy involves more than just meeting with your attorney and signing a few papers. Just as you wouldn't want to undergo an IRS audit without competent representation, you want a Bankruptcy attorney with the necessary skills and experience.

What you must do before coming in:

Prepare all income taxes you are legally obligated to file, especially those old taxes. You don't have to file the taxes, and you don't have to pay the taxes, but you do have to get all returns prepared.

The returns don't have to be perfect, but everything in them must be truthful.

Bring in the following documents with you to the first visit to our office
  • Your ID – Drivers license and Social Security card
  • Tax Returns - 3 years, 4 years for Chapter 13
  • Pay stubs - 6 months
  • Pay stubs for Spouse - 6 months (even if not filing)
  • Paperwork on any Lawsuits/Judgment(s)/Garnishment(s)/Foreclosure
  • Divorce Decree if divorced within past 3 years

Know where you are spending your income and be ready to tell us about it. As you complete your credit counseling, you may wish to print out the information on where you are spending your money.

List who you owe and how much you owe. Open your bills and look at them. Some people just cannot bring themselves do this, and we understand. If you prefer, give us your bills and we will open them, look at them, and tell you how bad it is. However, there is an additional cost for this service.

If you want us (or any lawyer) to work for you, you need to pay. Until you start paying your attorney, nothing will happen!

If you want us (or any lawyer) to help you, you must tell the truth. Don't be embarrassed to be completely candid about discussing your money problems.

We've heard it all before, from the accountant who hadn't filed her taxes in ten years to the professor who lost over $200,000 in one year gambling! You don't need to apologize about having made mistakes if you are ready to learn from these mistakes.

Don't waste your time and money going to pre-bankruptcy credit counseling or getting a credit report. If you use our preferred online credit counseling agency, we will pay for the pre-bankruptcy counseling. We will also order your credit report as part of preparing your Bankruptcy.
